\u2022 Products: All antique, vintage, collectible, and unique items offered for sale on the website.
\u2022 Buyer: The natural or legal person who enters into an agreement with the seller.
\u2022 These terms apply to all offers, orders, and agreements, to the exclusion of any terms and conditions of the buyer.<\/p>\n\n\n\n
\u2022 Unique Character: The buyer acknowledges that the products are antique, used, or vintage. This means that products inherently may show signs of age, wear, restoration, or prior repairs.
\u2022 Description and Photos: We do our utmost best to describe and photograph the condition of the product as accurately as possible. Slight color deviations (due to monitor settings) or the lack of details in the description that are inherent to the age of the item cannot be classified as a defect or non-conformity.
\u2022 Functionality: Unless explicitly stated otherwise (for example: “fully restored and functional”), mechanical, electrical, or technical objects are sold as decorative collectibles. We do not guarantee their functionality.<\/p>\n\n\n\n
\u2022 Margin Scheme: Since these are used and antique goods, the statutory VAT margin scheme is applied in many cases. This means that no VAT is listed separately on the invoice, unless the product falls under the regular VAT regulations.
\u2022 Prices: All prices are listed in Euros (\u20ac), excluding shipping costs and any customs duties or import taxes for shipments outside the European Union.
\u2022 Payment: Orders must be paid in full in advance using the payment methods offered on the website before the Product is shipped.<\/p>\n\n\n\n
\u2022 Packaging: We take the greatest possible care to pack unique and fragile objects safely and securely to prevent breakage.
\u2022 Insurance: Given the value and irreplaceable nature of antique items, orders above a value of [Amount, e.g., \u20ac100] are shipped exclusively by registered and insured mail.
\u2022 Pick-up: By mutual agreement, the Buyer may choose to pick up fragile or large objects at our location: Kapelstraat 81, 3590 Diepenbeek, Belgium.
\u2022 Transport Risk: The risk of damage or loss during transport lies with the seller until the moment of delivery to the buyer (in the case of a consumer purchase), unless the buyer has appointed their own carrier.<\/p>\n\n\n\n
\u2022 Reflection Period: Consumers within the EU have the right to dissolve the purchase within 14 calendar days of receipt without giving any reason.
\u2022 Condition upon Return: The product must be returned in exactly the same condition as it was sent. If the item is damaged, altered, or improperly packaged for return shipping due to the buyer’s actions, we reserve the right to deduct the depreciation in value (which can amount to 100% for unique antique items) from the refund.
\u2022 Costs: The costs and risk of the return shipment are entirely at the expense of the Buyer. We strongly advise always shipping returns with insurance.<\/p>\n\n\n\n
\u2022 Warranty: Due to the historical nature of the Products, no manufacturer’s or functionality warranty is granted after delivery, unless agreed otherwise in writing.
\u2022 Authenticity: We carefully investigate the origin and age of our Products. If, within [period, e.g., 6 months] after purchase, it is proven by means of a recognized, written expert evaluation report that an item is a modern forgery, the Buyer is entitled to dissolution of the purchase and a refund of the purchase price.
\u2022 Consequential Damage: The Seller is never liable for indirect damage, consequential damage, or damage to persons or other property resulting from the (incorrect) use of the delivered antique items (such as old wiring in antique lamps).<\/p>\n\n\n\n
\u2022 All photos, texts, and product descriptions on this website are the intellectual property of Antiek Folklore and may not be used or copied by third parties without prior written consent.<\/p>\n\n\n\n
\u2022 All legal relationships to which the Seller is a party are exclusively governed by Belgian law.
